Reply from Commissioner Avromopoulos to the question concerning compatibility of the Commission proposal on a common list of ‘safe countries of origin’ of asylum-seekers with EC law and the Charter of Fundamental Rights (CFR)
The application of the concept of safe country of origin does not affect the Member States' obligations to examine and take decisions on applications individually, objectively and impartially. In the explanatory memorandum to its proposal for a regulation of the European Parliament and of the Council establishing an EU common list of safe countries of origin for the purposes of Directive 2013/32/EU of the European Parliament and of the Council on common procedures for granting and withdrawing international protection, and amending Directive 2013/32/EU(1), the Commission set out explicitly that particular attention should be paid by Member States to the circumstances in a third country included in the EU common list of safe countries of origin, when determining whether that third country is considered as a safe country of origin for a particular applicant as well as during the examination of an application using the procedural facilities provided for in Directive 2013/32/EU in relation to applicants from a safe country of origin.
