Reply from HR/VP Mogherini to the question concerning coordination between the Council, the Commission and the Kingdom of Morocco in relation to the appeal against the General Court judgment delivered on 10 December 2015 in Case T-512/12 Polisario Front v Council

As in every Court case, the institutions decide entirely autonomously how each case is presented to the Court of Justice. Issues of common interest with Morocco are nevertheless, obviously discussed during contacts between the Union and the Kingdom of Morocco.

The judgment in Case T-512/12 has an impact on the relationship with Morocco, since it partially annulled the decision concluding an agreement amending a protocol to the association agreement. On that basis, the principle of cooperation under the association agreement justifies that the Union and Morocco discuss the way ahead.

As regards the sharing of pleadings, as in every Court case, it is not the Commission's practice to exchange its own pleadings with third countries not party to the court proceedings. Pleadings of other parties can only be exchanged with their consent.
